Terms of Service

Welcome to Delishable. These Terms of Service ("Terms") govern your access to and use of the Delishable mobile application ("App"), available on iOS and Android, and our website at https://delishable.app ("Website"), which provides information about the App (collectively, the "Service"). By creating an account, downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account, downloading the App, or otherwise accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2. Description of Service

Delishable is an AI-powered meal planning and recipe management application that allows users to:

• Enter available pantry ingredients to receive personalised recipe suggestions
• Generate AI-powered recipes tailored to your ingredients, dietary preferences, and cooking skill level
• Plan meals using an integrated calendar feature
• Save and organise favourite recipes
• View nutritional information for recipes (calories, protein, carbohydrates, and fat)
• Access a shared recipe library contributed to by all users

The Service is available on iOS and Android devices through the respective app stores.

3. User Accounts

3.1 Account Creation and Security

To use the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must notify us immediately of any unauthorised use of your account.

3.2 User Data

Your account data, including pantry items, saved recipes, and meal plans, is associated with your account and stored securely. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your personal data.

3.3 Shared Recipe Library

When you generate recipes using the Service, those recipes and their associated AI-generated images may be saved to our shared recipe library. This library is accessible to all users of the Service and helps improve the experience for everyone. Recipes contributed to the shared library are not deleted and become part of our permanent collection.

4. Subscriptions and Payments

4.1 Subscription Plans

The App offers subscription-based access to premium features. Details of available subscription plans, including pricing and features, are displayed within the App and may change from time to time. By subscribing, you agree to pay the applicable fees for your chosen subscription plan.

4.2 Billing and Payment

Subscriptions are billed through your Apple App Store or Google Play Store account. Payment will be charged to your account upon confirmation of purchase. By subscribing, you authorise the applicable app store to charge your payment method for the subscription fee.

4.3 Free Trial

We may offer a free trial period for new subscribers. If you do not cancel before the end of the free trial period, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee. Free trial eligibility is determined by the Apple App Store or Google Play Store and may be limited to one free trial per user.

4.4 Automatic Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate.

4.5 Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to premium features until that time. We do not provide refunds for partial subscription periods.

4.6 Refunds

All subscription purchases are processed through the Apple App Store or Google Play Store. Refund requests must be made directly to Apple or Google in accordance with their respective refund policies. We do not have the ability to process refunds directly.

4.7 Price Changes

We reserve the right to change subscription prices at any time. Any price changes will apply to subsequent subscription periods and will not affect your current subscription term. We will provide reasonable notice of any price increases through the App or by other means.

5. AI-Generated Content

5.1 Recipe Generation

The Service uses artificial intelligence to generate recipes and recipe images based on your inputs. While we strive to provide accurate and helpful suggestions, AI-generated content may contain errors, inaccuracies, or unsuitable recommendations.

5.2 Nutritional Information

Nutritional information displayed in the App (including calories, protein, carbohydrates, and fat) is estimated by AI and should be treated as approximate guidance only. This information is not a substitute for professional dietary advice. If you have specific dietary requirements, allergies, or health conditions, please consult a qualified healthcare professional or registered dietitian.

5.3 Food Safety

You are solely responsible for ensuring that ingredients are fresh, properly stored, and safe for consumption. The Service does not verify the safety, quality, or suitability of ingredients you enter. Always follow proper food handling and cooking practices.

5.4 Allergies and Dietary Restrictions

While the Service aims to accommodate dietary preferences, it cannot guarantee that recipes are free from specific allergens or suitable for particular dietary requirements. Always carefully review all ingredients before preparing any recipe, especially if you or anyone consuming the food has allergies or dietary restrictions.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable local, national, or international law or regulation
• Attempt to gain unauthorised access to, interfere with, damage, or disrupt any parts of the Service, servers, or databases
• Use any automated system, including robots, spiders, or scrapers, to access the Service
• Reverse engineer, decompile, or disassemble any portion of the Service
• Upload or transmit any malicious code, viruses, or harmful data
• Use the Service to generate, store, or distribute inappropriate, offensive, or illegal content

7. Intellectual Property

7.1 Our Rights

The Service, including its original content, features, functionality, design, and underlying technology, is and will remain the exclusive property of Delishable and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

7.2 AI-Generated Recipes

Recipes generated through the Service are created using AI technology and become part of our shared recipe library. You may use these recipes for personal, non-commercial purposes. You may not claim exclusive ownership over AI-generated recipes or prevent others from accessing or using them.

7.3 User Content

By inputting ingredients or other information into the Service, you grant us a non-exclusive, worldwide, royalty-free licence to use this information to generate recipes and improve the Service.

8. Third-Party Services

The Service may integrate with or contain links to third-party websites, services, or content. We do not control and are not responsible for any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those third parties. This includes, but is not limited to, the Apple App Store, Google Play Store, and any AI service providers we use to generate content.

9. Disclaimers

9.1 "As Is" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantee

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or servers are free of viruses or other harmful components. We make no guarantees regarding the accuracy, completeness, or reliability of any content, including AI-generated recipes, nutritional information, or cooking instructions.

9.3 Health and Safety

THE SERVICE IS NOT INTENDED TO PROVIDE MEDICAL, NUTRITIONAL, OR HEALTH ADVICE. ALWAYS CONSULT QUALIFIED PROFESSIONALS FOR DIETARY, HEALTH, OR MEDICAL CONCERNS. YOU USE ANY RECIPES OR NUTRITIONAL INFORMATION AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DELISHABLE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING AI-GENERATED RECIPES AND NUTRITIONAL INFORMATION; OR (IV) UNAUTHORISED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Indemnification

You agree to defend, indemnify, and hold harmless Delishable and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Service, including any use of the Service's content, services, and products other than as expressly authorised in these Terms.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If your account is terminated, any active subscription will also be terminated, but you will not be entitled to a refund for any unused portion of your subscription. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Delishable regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements between you and Delishable.
